How to get a stay order on a divorce decree?


A stay order is a temporary stoppage or postponing of a judicial proceeding. This stoppage does not mean that the said order has become invalid.

If you wish to postpone your divorce proceedings you can make an application to the High Court of your state. The application should state the reason based on which you want a stay order.

There are two kinds of stay orders:
  • Temporary- This can be obtained during the divorce proceedings.
  • Permanent- This can be obtained only at the end of the divorce case.
 
If your spouse is trying to get a stay order on the divorce decree passed in your favour, then you must file a warning petition (caveat) in the High Court to stop the stay.
