Basis on which your divorce petition can be rejected


Your divorce petition shall be rejected if:
  • You have filed for a divorce within one year of your marriage.
  • You have not filed the petition in the appropriate family court.
  • Your spouse is not willing to divorce and files a petition for restitution of conjugal rights, which is granted by the court.
  • The reasons based on which you want a divorce do not fall under grounds of divorce given under your personal laws.
  • Further if your petition is rejected in the family court, you can file an appeal before the High Court of your state.
  • To avoid any of the above, you must consult/hire a well qualified and experienced lawyer.
