What to do if tenant is missing since 2 months ?

Tenant who are living in my home are not there since two months, we are not able to contact them also... There things are in home but they didn't come back from more then a month... They didn't pay rent two months fifteen day.. so what action should I take now? We have security deposit

Steps to be taken in case the tenant not traced out:

1.You lock with a new lock over it and paste a lawyer notice on the door.

2. Lodge complaint with police and ask them to conduct panchanamma and remove the things belonging to the tenant.

3. Rent out to new tenant, if the tenant did not turn up 90 days.

It is also the bounden duty of landlord to get the tenants permanent address before entering into rent agreement. He cannot give the house on rent to unknown persons like terrorists, antisocial elements, cheaters etc., Land lord is responsible for the illegal activities tenant if such activities took place from the tenanted premises.

Laws now allow landlords the right to evict a tenant on the grounds of breach of rental agreement; subletting rented premises or a part of it without landlord’s permission; default in payment of rent for specified period; misuse of the property; or conducting illegal activities in the rented premises. The landlord also has a right to evict a tenant if he or she requires the building for his or her own occupation.To prevent tenants from overstaying, landlords can also add a clause of hike in rent in the agreement, if the tenant does not leave when the contract ends.
