What to do if tenant has occupied land without my knowledge

I had buy a land of 5 acres in 1982 . While in 2004 someone of person came property without noticing me and become occupied my 3 acres of land (kabza ) . He never imminented me till today he is occupying my land . I never checked my land due to my study and serious family problems . Recently ” Government of Telangana “ asked to verify us lands by using 1b form . Where my passbook stating that the lands belongs to me but he become tenant without notify me . Now I wanna file a case against him . What are my chances to win the case

A police complaint should be made as soon as possible. Under the Indian Penal Code, 1860, any unlawful entry into property in the possession of another with an intent to insult, annoy or intimidate another person is a criminal offence (Section 441). You are legally in possession even though you may not physically occupy the plot.

At the same time, a suit should be filed against the persons involved against such trespass. This will not easily yield a remedy but is important for the maintenance of your legal rights. In such suit, you should also ask for a declaration that the property belongs to you and not any other person.

Sir you said that you are the owner of the land have you checked the revenue record whether any documents stands in his name who is on the land now. If he is there without any proper documents then you file suit for declaration and recovery of possession. Call us through website for assistance
