You need to file RTI of that open space to use as an evidence and report it to the appropriate authority like local municipal , MRTP and also send a legal notice and cc it to local police. Your question needs more details like who are you Are you a landlord And also what is the location?

Well, you can lodge a Civil Case as well as a Criminal Case against that Tenant who is frequently encroaching open space and on top of that, legitimising his claim by pasting a Notice Board, that, no one could trespass on his land.
