Tenant not vacating and not paying rent and he is not opening shop

My tenant is not paying rent since 2019 and not vacating the shop and he is not running business too. He sent us court notice in 2019 .After sending court notice the we are troubling him.
hi first need to see whether there is any rental agreement existed between you and him and ig he is not paying the rents to you then you could send notice to him and file petition in court and also need to see the notice sent by him
