Tenant is not obeying the rent agreement. And make excuses.

Tenant earlier said she is widow, but later we came to know she is divorced and had two marriages. She doesn't behave politely with us, very rude but before living here she was so respectful to us. She is a liar.tenant doesn't pay full monthly rent,she says to vacant the flat on particular date every time but fail to vacant. Can I stop electricity, water supply of the flat because of non payment of rent and not vacanting the flat. She is relax in cooler air, we are in headache. Please advise us

You cannot stop electricity or water supply as this would amount to unlawful eviction and harassment under Indian tenancy laws. Instead, serve a legal notice for non-payment of rent and breach of tenancy terms. If she still fails to vacate, file an eviction suit before the civil court citing default in rent payment and misrepresentation. Courts take such cases seriously, especially when there’s clear breach of agreement. Do not take any step that may be considered illegal, as it can weaken your case.

At the outset you can send a legal notice for demand of arrears of rent and termination of license. Thereafter only we can seek eviction of the tenant. Due course of law is to be followed for the vacation of the premises. Feel free to contact Thanks

Under Indian law , you cannot stop essential services for rent non-payment or tenant behavior. Her marital status is likely not a valid eviction ground unless it breached a specific lease term. To recover unpaid rent, send a legal notice. For eviction, follow the legal process through the Rent Control Court or civil court after proper legal notice notice.

you should legal notice with help of advocate and disconnecting the basic necessity would be offence and getting vacated would become deficult for you. you should follow legal procedures as given in Law.
