Tenant giving rent in rent control & not to us and not vacating house

My grandfather gave our ground floor for rent on verbal basis to a widow 25 years back. Since 2009 she is not giving rent and depositing it to Rent Control. 2013 onwards she is not staying in our property and residing at her own house. Only to possess our rooms she left some furniture. Please advice how to evict her as we need the rooms for my marriage.

It is necessary to file Eviction Suit on the ground of reasonable requirements specifying that the tenant is not residing in that rented premises. You are also entitled to withdraw the deposited rent from the Rent Control following due processes of Law.

you can bring a suit of eviction against the tenant. but before that kindly be adviced that you should collect all evidences of her residing at a different location from the actual house of yours. this will be easier for you to fight the case as the return of summon from that residence will help you in getting an ex parte decree against the tenant. file the suit immediately without any untoward delay.
