Procedure to claim compensation from tenant for damaging the building

My father had rented our shop for government ration shop in 2003 and the agreement period is for 3 years. They should have vacated the shop by 2006 itself but till now they have not vacated the shop. Whenever my father asked them to vacate they are not vacating(Saying reasons like, we don't have any other shops to move) and because of there continuous possession our shop is getting damaged. The concerned officer is not listening to our problems and not vacating the shop. Tried everything to convince them verbally but they are refusing to vacate. We are getting the same rent for all these years. Also, We would like to know if we can get any compensation for the damage they have done to the building.

You are legally entitled to get compensation for any damage done to your property by the tenant, whoever they are. You may represent to the District Collector and also to the Secretary, Govt. of Tamil Nadu, in charge of Public Distribution System having control over ration shops. You may send them a 'Quit Notice' asking them to vacate your property and deliver vacant possession thereof to you immediately, besides claiming compensation for the damage caused to your property.

You can file a suit for eviction.I would like to know where the property situate.you can Seek for the enhancement of rent with retrospective effect.you can also seek damages for the damages caused to the building
