Procedure for the eviction of tenant for not paying rent.

We live in madurai , with oral agreement a tenant occupied our house and now for past 2 yrs no rent has been paid nor vacanting the house . In this regard we have filed a complaint in police station , police said they break the lock and put all things in one room and we can use the house . Now we are confused and dont know how to vacant the tenant . Kindly guide and help us

If the tenant is still residing in your house, arrange to issue him a legal notice requiring him to pay you the arrears of rent up-to-date and vacate and deliver up vacant possession of the house within 15 days of the notice. If there is no response, you may file an eviction suit, along with an interim application for payment of arrears of rent forthwith.

You have to file a case before the rent control court for eviction,under wilfull default,non payment of rent.you cannot break the lock,by doing so you will be inviting criminal complaint by the tenant
