New tenant dropped off before occupancy, seeking full refund of token

08-Sep-2025 (In Landlord/Tenant Law)
Hi, I have got an advance of 30k and tenant dropped off before agreement and I have refunded 15k already on a good faith. But now he is sending a complaint against my wife on https://e-jagriti.gov.in/register because amount sent to my wife amount. Is it not legally right to deduct money if tenant dropped off. Regards, Phaneendra V.

Since there was no final agreement and the tenant voluntarily dropped out, you are legally entitled to deduct reasonable expenses or forfeiture from the advance before refunding. The complaint against your wife will not hold much ground if you have proof of payment and partial refund. You should maintain bank records, chats, or messages showing the refund and reasons for deduction. If the tenant escalates, you can reply legally and even send a formal notice explaining the deduction. I can help you draft a strong reply and represent you if any legal action is initiated — feel free to connect with me through this platform.
