Legal action that can be taken against landlord

 Hello sir.. M from kolkata . Staying in Bangalore in a rented house.. yesterday at night my mobile ph was stolen from the room . The windows are not in a good condition .. it doesn't get locked properly..after several times I have informed the land Lord.. but he didn't fix it .. and the mobile was stolen through the window. It happened Because of there lack of responsibility and neglegency. I called 100 and the police came. I complained and they have taken all the details. But i had to suffer a huge loss because of the owner.i want to ask you .. can I take legal actions against the house owner?

Firstly, you have choosen unconditioned house. You could had intimate the owner to repair the house before occupying the premises. It was the duty of owner to get repair the doors, walls, etc., and then give it to rent. That concern, you can give legal notice for keep good condition the house, if, he will not do so, You can take legal action.

Most rental agreements would highlight the duties of the landlord. Examine the rental agreement and pull the clause relating to maintenance of the house and its repairs. Thereafter, issue a legal notice against the Landlord for breach of Contractual obligations which lead to foreseeable losses. In the event the Landlord refuses to pay the amount claimed as damages, a Civil Suit can be filed.
