Improper Deposit deduction and interfering objects of the tenants

15-Jun-2023 (In Landlord/Tenant Law)
Hi!We were 4 Bachelor girls staying in 2BHK flat in Mumbai. Our rent agreement finished in April. But as we could not find the replacement for a girl who left,we were given a short notice of 20 days to vacate the flat- by 15th May.While we were packing, the owner started renovating his sofa while we used to go to office.By the end of the week,we realized that they threw away some of our things- rugs, yoga mats study tables and most importantly- my genuine leather rolls worth Rs 5600.They told that they threw it thinking its garbage. When I got mad on this, the owner lady threatened me that she now cut our money from deposit. When they gave the deposit back, they gave no written breakdown of the damages they claimed on us and cut 5k per girl,so total 20k for the damages of the total deposit of Rs 1.5 lac. They are not providing any breakdown in written.I went to police to complain about my thrown leather. Then they finally agreed to give 50% of my loss but Ihave not transferred the money yet

This is my response to you: 1. Did you file an FIR or NC ? 2. You can pursue the criminal case against them; 3. You can also send a legal notice and try them under a civil case; 4. Worse comes to worst then you can approach rent controller or courts; 5. Consult a local lawyer and take steps.

You can write a legal notice to them regarding the same. If they don't give the same back to you then further legal action can be taken against them. Kindly contact us for a detailed discussion with respect to your matter. Thanks and Regards
