How to vacate my tenant even if we give multiple notices through email
05-Aug-2023 (In Landlord/Tenant Law)
Hello Sir/Madam
I gave notice in Feb to my tenant to vacate my flat in Apr as per the agreement. He requested to extend the notice to May due to a pandemic situation and as an owner, I agreed. I totally forgot about this due to my work and my tenant did not vacate in May and failed to pay rent on time. I called him to ask about rent and why he is not vacating the property.
My tenant said he misunderstood that he can stay when he paid rent. Again I clearly emailed him to vacate on Aug 15. He came up with a new reason "aadi" Tamil month he cannot vacate. Again I agreed and extended the date to Sep 15.
Yesterday he emailed me that his father died on July 17 and he cannot vacate for another 3 months.
My tenant is a lawyer too. I really do not know how to handle this situation. In another 3 months if anyone dies in his family, will he ask another 3 months to vacate??. I request you to guide me in the right direction
Thank you
Swarna

In this case, An eviction notice has to be sent before initiation of eviction. ... If the tenant does not comply with the legal grounds and refuses to move out, an eviction procedure could be started. Valid grounds for moving the court for eviction are the failure to pay rent and refusal to move outpost the end of lease period. I have a vast practice in that area you can seek my assistance in your matter.
