How to file a complain with BMC interference by neighbor in property

24-Aug-2023 (In Landlord/Tenant Law)
Current structure of our building is such that out neighboring flat is adjacent to ours with Hardly 1 inch space between the doors. He already has a door inside his flat now he wants to make another door opening outside which blocks my door and corridor there will be very little space left to even walk to my home There is no space to make a door opening outside because the space becomes congested . There are three doors ours, his and one washroom door adjacent to each other. When you tell them they say this passage is my property and I can do what ever I want. If he makes this door there no proper place to walk because the where the doors are adjacent to each other is very small.Can I complain in BMC What can we do in such situation?

Hello,
whether its Building or flat? as if it is a flat you can approach the society office and give a complaint in writing to your neighbor else if it is a building you have to approach a good lawyer and serve a legal notice upon your neighbor.

Hello,
You may take following steps:

1. Lodge written complaint with municipal corporation against any illegal construction done by your neighbour.

This is my response to you:
1. Firstly complaint to the society;
2. If your neighbour does not resolve it then send a legal notice;
3. Second last step is to approach the BMC and file a formal complaint and ask the builder also to intervene;
4. The last step is to take to small causes court and let the judge adjudicate upon the same.
