How to evict tenant if he refuse to give rent

I have tenant in 2bhk flat in delhi. We have 11 months agreement. He is not giving rent since 3 month . Now he is rufusing to pay and said I will not evict from your house. What action should I take .

It needs to be checked how much is the rent first so that to ascertain that it does not comes under Delhi Rent control act. If it doesn't comes under Delhi Rent control act then we would be required to send a notice for terminating rent agreement and for eviction and still if he doesn't evict then file a suit for eviction against him and he will be evicted within 6-7 months.

As you have a 11 month rent agreement then your relationship will be governed by the terms and conditions of the same. Before answering it , one needs to examine the agreement to find fruitful remedy for you. And then a legal notice can be send to tenant for eviction and remaining rent along with interest.

Call me with your facts and details so that I can ascertain your case. Will need to analyse the Rental/Lease Agreement terms. Accordingly you will have to take legal steps to get him evicted as per your rights as a landlord.

A legal notice for eviction in the ground that rent has not been paid. Thereafter, file a suit for eviction against tenant in the court if the tenant is still not vacating the premises. Court may pass order for eviction or payment of rent until suit is pending in court.

You have send him a legal notice as per law and there after file a suit for possession or eviction petition depending upon your rent there after due process of law he will have to vacate as per order or with due process of Law thru an execution you can throw him out with police help
