Your question cannot be properly answered without knowing some details. first of all, the location of the flat is required and also the rent. Existence of any agreement and the term thereof are needed to answer your queries. if the tenancy falls within WBPT Act then the answer is 5 years but if the tenancy is within the purview of TP Act then the tenancy is terminated.
