Eviction of tenant who has been in occupation for more than 30 years
31-Jul-2023 (In Landlord/Tenant Law)
About 30 years back my father rented out a shop in his residential property in Malviya Nagar, Delhi, on pagri basis and on a monthly rent of Rs. 300/-. He made a will for that shop in my name and after his death I started getting rent which is now about Rs. 750/-. There is no time line to vacate the shop in the agreement. Can I get that shop vacated now? Please advise.
Yes you can get the shop vacated. You will however, have to go as per the procedure and the law prescribed. We can assist you in you getting back your property from the tenant. There will be more details needed to assist you more.
Hello Sir I have perused your query. In these circumstances you have to send the tenenat a legal notice giving him a stipulated time period to vacate the said property. Thereafter you have an option to file a suit for eviction in a competent court of law as per the existing laws.

In this particular scenario, an eviction petition may be filed in the appropriate forum praying for nullification of the rent agreement on pagri basis being unconscionable in today's times. Further and better particulars are needed for an effective opinion.
