Complaint against landlord for threatening for eviction.

Sir my father rented one room approx 120sqft for commercial use in his name for last forty years in Kolkata, as I am the only son we both were using this room for business helping my dad ,but my father expired recently on October 2016, after that the landlord stoped taking rent(Rs300pm) and demanded Rs 3 lakhs for bill change, i offered Rs50000 but landlord refused and threatened me that he will file eviction. So what is my stand? Please help.

First of all it depends on the area it is situated. If it's under a Municipal area then PT Act applies otherwise TP Act applies. I suppose it's in a Municipal area so as per PT Act, Since you have been paying rent, your legal status is that of a tenant. You have inherited the tenancy rights for five years after your father’s demise. Issuing a rent receipt in favour of a dead person is not right. You are not liable to pay the amount he is demanding but, after the completion of five years or anytime before 5 years, you will have to get into a fresh contract.
So better if you negotiate properly. And if the landlord refuses to take rent submit it to the rent controller.

If you have receipts of payment of Rs.300 or any sort of agreement if made between your father and landlord then try to make a payment through money order if they refuse to accept the emo then pay your rent before the rent controller.
