Can tenants be debarred from flat if landlord did not pay maintenance

18-Sep-2023 (In Landlord/Tenant Law)
Hello, I was just threatened by the society committee members that I, the tenant, won't be allowed to enter the premises as the landlord has not paid maintenance charges for last 6months. They didn't give us any time or reason and told us that if they harness are not paid by Monday they will tell security to not let the tenants in the house. Now we have always paid all our rent in time. Is it legal for the society to stop us from getting into our rented house for which h we have a legal agreement, rent paid for, security deposit paid and there is no breach of contract. We have never had a single problem or complaint from anyone through our stay here. We live in Andheri east Marol region. We have been given one day as notice in a dispute between two different parties. Please help us figure out our chances here.

If your tenancy agreement states that the landlord should pay for the maintenance and he or she has refused to do these you should tell the landlord that he is in breach of your contract. Follow these steps:

Write to your landlord informing her/him of the maintenance charges which need to be paid.
If you do not get a satisfactory response to your letter, send a follow up letter giving your landlord a deadline by which you expect a reply.
If you are still not satisfied with your landlord's response, you can write again informing the landlord of your intention to involve the local council if the he has not paid the maintenance fee.
Keep copies of all of these letters as they will be important to you if your dispute ends up in court.
