Can eviction be done on the grounds of tenant being out of the country

Sir mera naam tarun hai main jalandhar punjab se belong karta hoon sir humne ek dukan rent par di thi uske saath 11 month ka rent agreement karvaya tha lekin woh kirayedaar agreement canada chala gaya agreement karne k doosarey din usse pehle agreement uske father k naam par tha jo 20 saal tak humari dukan pe kirayedaar raha dono bahar canada mein hain abhi usko gaye huye mahina hua hai to kya hum dukan khali karvaney ke liye kya kar sakte hai woh hume yeh bol kar gaya hai ki main 4 months ke liye ja raha hoon kya hum koi legal action le k dukan khali karva sakte hain yaan k nahi
You will have to file petition under section 13 of East punjab urban rent restriction act for eviction of tenant on the basis of personal necessity and for non using by tenant , otherwise there is no option you have.

When the landlord proves that the tenant has left the shop and has gone out of country with intention not to return. You have right under rent act to get the shop vacated . You can also file a civil suit and restrain tenant from subletting .
