Q: Challenging will of father in the court of law

My father had 11 kanal and 10 marla land on the gt road which is so expensive. we are 3 brothers and 2 sisters. now my father has died. but just before death, he had transferred land to my two brothers, he didn't give a single penny to me. but he had not transferred by registry, it is transferred by vasihat . so someone told me that i can break that vasihat by legal case in court and can get my land. so thats why , i need your advice . please guide me.

Q: What can I do to reacquire property illegally occupied by relative

My cousin (son of my father's sister son) has illegally occupied the property of my father who has passed away in Ludhiana. This property must be evicted by my cousin, sold and the money distributed to legal heirs who are we five brothers and sisters. I and my brother live in USA, one sister in UK and two in India. Can you help. If yes, what is required to pursue further.

Where is the property situated n Ludhiana.Property number, house whether any shops etc also . Plz give complete description, of property. The area of property.The tile documents u have of property. Any will was left by your father or not.All the documents u have relating to property.IMP was ur cousin living with ur father or very close to himIs ur cousin, resident of Ludhiana.After all above info we will get u relief u want.

Yes u can claim each and every inch of land which ur late father owned. Even if ur uncle is in possession. The land paper might have been got lost deliberately so as to put u out off ur fathers property. The name of village and Tehsil & District will be sufficient to get land papers.

When the landlord proves that the tenant has left the shop and has gone out of country with intention not to return. You have right under rent act to get the shop vacated . You can also file a civil suit and restrain tenant from subletting .

Q: Acquisition of land during the 1984 riots

Sir my grandfather had fought indo pak 1963war.he was rewarded with 11 killas agriculture land in amritsar punjab.during 1984 riots he had to leave the place and went to rajasthan.he gave land to some Jatts.but no written documents were there for they had not paid.now my grandfather is dead.on the net it is showing his name.can it be transferred to his 3 sons namen after he is dead.though some girdoria have been broken by Jatts.

The ownership as u stated remains in name ur grandfather in Farad Jamabandi . Since farad are on net. This is sufficient document to show title of ur grandfather. He is owner, the breaking of girdawari does not effect tile of ur grandfather. The land will be transferred ( mutated) in name of his son s and wife if alive. Moreover the grant is recorded in govt records. I can help u to get land and rent from those persons cultivating ur land. Thereafter u can sell land etc as u want.Specify the place in Amritsar Distt.
