What to do when Bank cancels resignation when serving notice period?
10-Oct-2023 (In Labour & Service Law)
I am currently working with a Public Sector Bank in India. I gave my resignation letter on 21.08.2017 stating that I am willing to serve the notice period from 1st Sep 2017 onwards for 1 Month. However, due to some personal issues I had to proceed on unauthorised leave from 28th Aug. Bank sent me various letters starting from 31.08.2017 onwards asking me to join the bank immediately and also advised me in writing that any leave during the notice period which was to start from 1st sep would result in extension of the notice period by that many days. I resumed on 26th Sep as per their instructions and has been serving the notice period for last 2 weeks. Now, the bank has advised me that my notice period has been cancelled and as per terms of employment I have to deposit One Month Salary for not serving the notice period from 1st Sep 2017. However, I never received any letter of acceptance for my resignation letter that I forwarded on 21.08.2017. Is it justifiable to ask me to deposit??
Send a representation to the higher Officials of the bank because if you are willing to serve the notice period then there is no occassion to deposit one month's salary.
