28-Jun-2023 (In Labour & Service Law)
I have been shortlisted for a post in delhi deppt whose exam was conducted by DSSSB. I have uploaded my e-dossier also. They have issued a advt for 290 posts in which 109 was for general candidates. They have issue a final list till date for only 98 candidates. Still there are 11 seats vacant in tbe general category. My roll no was not there. I m lagging behind by only point 75(.75) marks from the candidates whose roll no appears in the last list. Seats are still vacanct. I want to know whether i will get this job. Will i won the case or not? How much chances are there

This is a fit case for writ petition in High Court. But one must need to know the following:

1. Whether all seats are to be filled ?
2. Whether there is a cut off marks given irrespective of the seats available ?
3. Is this their final merit list? Is there any waiting list?

This issued need to be seen to see if this case is for writ petition or not.

As per information provided by you, you have a very good case. But there are certain things which are required to be clarified. First of all you have to clarify how many candidates are there in between you and the last candidates who secured the job, when did the last list got published, any further notice regarding same, etc.

Your chances of getting the job depends upon the factum of the no. of vacant seats and the next eligible candidates and your chances of winning the case depends on various factors, it cannot be confirmed at this stage without knowing the exact facts and without seeing the documents of the case.

Please take note of following steps -
1. File an RTI seeking information about how the concern department wishes to fill up the remaining vacancies. This will give you an idea as to whether they are considering candidates from previous exam or they are planning a new exam. If they are planning a new exam then you have to appear for that exam to get selected for the said post.
But if they are uncertain as to how they are going to fill up remaining seats or they are considering previous candidates as per previous scorecard then you can approach for your selection.
2. If they refuse to accept your application based on the RTI information then you can approach the court for the same.
