What is the eligibility for gratuity

Private limited firm, declared employee at present is 10, No. Of Directors 4, working period 20 years, salary by cheque for last 10 years, present salary 35000. Am i eligible for gratuity

Yes you are eligible for gratuity. The Payment of Gratuity Act, 1972 (the Gratuity Act) is applicable to employees engaged in factories, mines, oilfields, plantations, ports, railway companies, shops or other establishments with ten or more employees. (see 10 or more) So, company must pay your gratuity amount. But it needs to be seen when did company register under the The Payment of Gratuity Act, 1972 Hope this helps Prakhar

Yes u r eligible , 5 years is the continuation work in the company . Un have to apply for gratuity if I going to wave or retire than u will get the gratuity otherwise u can nock the door of the court.
