Salary b/w the period of resignation and withdrawal of resignation

I resigned on 31 July and withdrew my resignation on 17 October. Due to a departmental lapse, my withdrawal was not processed in time, and now my salary for this period is being withheld/disputed. I need your advice on whether I am legally entitled to salary and continuity of service for 31 July to 17 October, and what steps I should take to resolve this.

Hi, It depends if your resignation in July was not formally accepted or you continued to work, mark attendance, and discharge duties, you had the right to withdraw the resignation in October. Further, details like what was exactly the lapse of the department and other details shall help you advise better. The primary legal step is serving notice to clear the dues

If you continued working and your withdrawal was submitted in time, you are entitled to salary for 31 July–17 Oct. Salary can’t be withheld for employer’s lapse. Write to HR, seek records, and approach Labour Authority if unpaid after sending a Legal Notice!
