Probation employee misused email, now demanding salary

I hired a probationary employee (2-month trial) who misrepresented brokers as direct charterers, added unauthorized broker emails to our company ID, and asked for client lists. I terminated her within 11 days for misconduct. She is now threatening legal action for unpaid salary. Can I file a cybercrime complaint in advance to protect my company under

you can file a data theft case against that probationary employee, if the employee mentioned shared any data of your concern to another who is carrying out the very same activity as if yours or to anyone with an intention to effect loss of business as well to gain any benefit to the mentioned from anyone without your consent or permission
