Non payment of salary for last 5 months by my ex-employer

My company has not paid me salary for last 5 months and when I ask them regarding that then they just say that it will happen within a month or next week but it never does. I believe that they are shutting down their business within a month as they are already in lot of debt. I have all the necessary proof and documents ready with me. Can someone please help me in what actions should I take? I'm planning to submit a complaint letter with labour commissioner, do you think will it be beneficial?

Submitting a Complaint to the Labour Commissioner may help you, if you are a Labourer, otherwise no, it may not help you. It is best to serve a Legal Notice first to recover your Outstanding Salary, if things won't work out after sending Legal Notice, then, file a Civil Suit against them in Court.
