My Employer is not giving me salary for the last 3 months.
10-Mar-2025 (In Labour & Service Law)
My Employer at the company where I'm working is not processing my salary for the last 3 months despite asking for the same many times, my boss is ignoring me on this issue, I have even told him that i'm quitting but still no action is being taken to process my salary, I have the offer letter on which it's clearly metnion that my per month salary is Rs. XXXXX, please advise me what should I do in such situation.
Sir, firstly your offer letter and contract or agreement has to be gone thoroughly. If there is no clause regarding advance notice to be served by you, then we must issue a legal notice enumerating the dues payable by them.

Dear Sir/Ma’am,
In the current situation you could send a legal notice to you previous company requesting to process the FnF and if they fail to do so then you can approach the Labour Court or the Court of other jurisdiction seeking a remedy depending upon the circumstances.

2- file a court case in labour court or writ petition before HC

For unpaid salary, you can complaint in concern labour commissioner office. no employer can hold salary without a reason. as per payment of wages axt 1936 employer is supposed to pay wages by 7th of subsequent month.
