Maternity act for startup - Asking to resign while on maternity leave

I want to know is maternity act and law applicable for startup? My employer asking me to resign while I am on maternity leave . I got 3 month of maternity leave and after one month of leave, I received email from my employer and asked to resign.
Hi Madam,
I may know how many years or months you worked in that company
and when did the company started and where it is located
did you work from home after how many days you joined in the company

Maternity Benefit Act, 1961 is a statutory act and is applicable in a startup. The employer cannot do so and if he does then there are statutory benefits which a women gets for at least 26 weeks as per the latest amendments.
