Legal action against company for terminating employees services

Dear Sir, We are 26 employees working in a private company, on March 5, our AVP and HR Manager came and directly told us that the process is not going to run in Mumbai and it will only run in Hyderabad site only so we will be not working on any production and we have to serve 2 months notice period and then we have to leave the job, they are paying us the compensation according our tenurity but we didn't find any other jobs in the market as some of us have high-packages or high experience and the compensation which we are getting is not enough for us, so can we file a case against the company

Hi

You have not mentioned whether there is employment Contract between the Company and you if you are drawing high salaries. If there is a contract termination has to be done as per the termination clause. If no termination clause exists it has to be done as the per the State Labour law and if same is not followed you have to put them to notice that you will approach the Court.

This is my response to you:
1. You can write a formal letter to the HR as well the AVP requesting for higher compensation w.r.t to the long tenure you have, a short term notice to find new job;

2. You can also read the terms of your employment to know how this company rules are?

3. If the company still does not offer you higher compensation then send a legal notice;

4. If the dispute persists then approach the labour commissioner;

5. Last option is to file a writ in the high court as a method of last resort.
