FIR mentioning in Attestation form needed or not

03-May-2025 (In Labour & Service Law)
I have to submit duly filled attestation form with respect to my central government job joining. Meanwhile, I had recently submitted a statement in Police station in an FIR in which I am accused. So my question is whether NO should be the response to the Questionnaire - Is any case pending against you in any court of law at the time of filling this attestation form. Since the FIR is in questioning stage, technically the answer should be NO to Court of law question. Pls guide

You must state No while filling the attestation form. However, it is imperative to know as to under what provisions of law has the FIR been lodged against you. It is always to put in a rider about the FIR. Feel free to contact me for seeking any legal advice as regards the same.

Well, while duly filling the attested form with respect to the Central Government Job, you must disclose the fact to the questionnaire, that, yes, a Criminal Case is pending against you after the lodging of FIR, as if you do not disclose this fact, then, later on, you can be terminated by Central Government, if they come to know later on, that, you have lied to them during background verification + you may face Jail Punishment too later on.
