Contractual basis job in MP government can I claim for permanent job

Respected, I am doing contractual basis job in MP government from past 4 years, can i claim for a permanent post. (I was recruited through written exam followed by interview.) It was written in my appointment letter that the job is only for three years and i have completed three years successfully and after that one more year i provided my service to the department,. Now they want to terminate me and refill the post again for three years, isn't it s injustice. they are termineting me and refilling the same post for same period instead of continuing me.

your case falls under the category of contractual or casual worker and in such category after the judgment of UMA Devi case State of Karnataka things have become worst for the employees who are falling in such category. it is opined to you that participate in the process of appointment. there is legal position against you as you have said that you are a contract employee so you are bound with the contract condition. it is also advised that no body can restrict you to participate in the selection process, if so, then legal remedy is available to you. under the law you can't compel the authorities to continue you.

Though there is no legislature prescribed in this behalf, however, referring to few judgment by Hon'ble HC, MP if you continue for 7 years you may claim for permanent position.

in your case you can approach to Hon'ble HC under Art 226
