Complaint against employer for not giving relieving letter and FnF
15-Mar-2023 (In Labour & Service Law)
, previously I worked in one private company. I will resign my job with notice period 45days. Now they cannot release my Releaving letter & settlement for me. The HR say now I have 90 days notice period, but I have 22 earned leave, 9 casual leave,18 sick leave. What can I do? Help me
No employer can retain you against your will and what is the notice period stated in your appointment order. if you want immediate relief you have to pay the salary due for the notice period to the employer and get yourself relieved and get the balance of legal dues from your employer. you can encash your earned leave if it is provided in your company standing orders or is provided in the settlements
How do I convince my new employer if I don t have a relieving letter?
You can also provide proof in other ways. For example, if you do not have a letter of experience or one confirming your resignation, you could use pay stubs or tax documents. Or you could ask a former supervisor to write a letter of reference. These documents will help you to prove your experience and skills.
What happens if a company does not provide experience letter?
Discuss with your manager or HRM the reasons why they are not able to give you one. You should have completed your notice period and any other formalities prior to leaving. You should send a formal letter and email to them if they dont give you a convincing response.
