Can i submit medical certificate for not serving notice period
07-May-2023 (In Labour & Service Law)
i have worked for a company in Noida for approx 6 years. I had to resign on medical background immediately so havent served notice period of 30 days. I have asked my company to release my gratuity amount.
My question is: My company wants me to pay them for not serving notice period. So, can i submitt medical certificate so that i do not have to pay for notice period which i was not able to serve. Also can my employer deduct amount from my gratuity ?? Please help.
You can definitely submit the medical in order to get some leverage. Further, if the Gratuity is in the Government Funds then the company also can't stop it's payment and in case it is in some trust of the company then you can claim it. The company cannot deduct your gratuity. For further assistance you can call me.
