Can Contract employee claim for Permanent role with client employer.

16-Oct-2025 (In Labour & Service Law)
I have been working more than 7 years to single client employer without any break in contractor basis and parent company is just a manpower supply company. Can I claim permanent role with client employer since this is an essential role. In same client company, this role is permanent in other locations/sites. Since they all being permanent role and I am the only person in this role in contractual basis. Please give some guidance through law.

Dear Client, 1. You cannot automatically claim permanent employment with the client company, even after 7 years on a contract. However, if you can prove that the client directly controlled your work (timing, duties, supervision, leave, etc.) and that the job is permanent in nature—especially since others doing the same role in other sites are permanent—you may claim regularisation under the Industrial Disputes Act, 1947 by alleging a sham contract. You can approach the Labour Commissioner first for verification and conciliation. 2. Consult an advocate to discuss your case in brief. 3. You may schedule an appointment regarding your case by phone or email at your convenience. Thanks & regards, Priyanka Advocate Coimbatore
