Am I bound to serve notice period if I have not signed a contract

16-Apr-2023 (In Labour & Service Law)

I joined a company and worked for them for 1.5 days, drawing 2 paychecks. However i left the job due to personal reasons and started a professional sports blog. They are threatening to sue me for fraud (starting a company while being employed to them) and demanding me to serve a notice period of 30 days as per the contract i didnt sign, or pay the salary for one month to them. Do they have a case?

Firstly, I believe you have tendered a written resignation. Secondly, Since there is no written contract your former employers legally do not have recourse to legal remedy based on the facts stated by you. In view of these points, you need not worry.

If you did not sign any such contract you are under no obligation to serve 30 days Notice Period.
Apart from this, no company can compel to any employee to work for them, against the free will of employee, in this case as per contract terms (generally compensation for not serving the Contract period).

They may have a case if you would have sign such contract, and the object of contract say so.
