Health insurance denied due to ongoing Depression treatment

Insurance company is denying me issuance of health insurance because I am taking treatment for depression. Isn't it a violation of MHC 2017 and all the following IRDAI Orders. I have tried complaining about the same to the company's grievance redressal forum, but they said their policy does not allow issuing the insurance since the person is taking treatment of depression. Do I have any case here?
