November 20, 2018
By Advocate Chikirsha Mohanty

The definition of cyber crime is pretty hard to come up with in today's age, where internet is spreading like wildfire and snowballing into a huge avalanche. But the basic definition of a cyber crime is any illegal activity that uses a computer as its primary means of commission. The rate of cyber crime in India is also on the rise but the figures might alarm you more. As per the study findings, during 2011, 2012, 2013 and 2014 years, a total number of cyber crimes registered were 13,301, 22,060 71,780 and 62,189 (till May). Currently, the cyber crimes in India is nearly around 1,49,254 and may likely to cross the 3,00,000 by 2015 growing at compounded annual growth rate (CAGR) of about 107 per cent. As per the findings, every month nearly 12,456 cases registered in India.

To tackle the issue of cybercrimes, CIDs (Criminal Investigation Departments) of various cities opened up Cyber Crime Cells in different cities. The Information Technology Act of India states clearly that when a cybercrime has been committed, it has a global jurisdiction. and hence a complaint can be filed at any cyber cell.

Let us have a look at the steps one has to follow to file a cyber crime complaint.

STEP 1: Keep in mind that you will have to provide name, mailing address & telephone number along with an application letter addressing the head of a cyber crime investigation cell when you go to file a complaint.

STEP 2: As with almost all police cases, the complainant will have to provide the following papers and documents at the time of filing the complaint. The valid documents are:

3) Access control mechanism details i.e.- Who had the access to the computer or email of the victim?
4) List of suspects if the victim is having any suspicion on anyone.
5) All relevant information leading to the answers to following questions.

  • What is compromised?
  • Who might have compromised the system?
  • When was the system compromised?
  • Why might have been the system compromised)
  • Where is the impact of  the attack-identifying the target system from the network?
  • How many systems have been compromised by the attack)
