We are a team of doctors planning to start an organization for medical tourism in India. We expect to receive patients from middle East, and Africa primarily to get treated in NABH accreditated hospitals in Delhi, Mumbai, Bangalore, Ahemdabad. We want to know what all legalities should we keep on mind before starting such a business and would this involve and legal liabilities from the patients country of origin in case of any complications. Dear sir, Starting a medical tourism business in India involves multiple legal and regulatory considerations: 1.Company Registration & Licenses – Register as a legal entity (LLP/Pvt Ltd) and obtain required licenses like GST registration, trade license, and clinical establishment registration (if applicable). 2.Medical & Immigration Compliance – Ensure compliance with the Clinical Establishments Act and NABH accreditation. Patients will need Medical Visas (M-Visas), and your organization can facilitate this process. 3.Contracts & Liability Protections – Draft comprehensive agreements with hospitals, doctors, and patients. Include disclaimers, limitation of liability, and jurisdiction clauses to mitigate risks of foreign legal claims. 4.Insurance & Risk Management – Consider professional indemnity insurance for doctors and liability insurance for your company to protect against malpractice claims. 5.Data Privacy & Confidentiality – Ensure compliance with Indian data protection laws when handling patient medical records. 6.Taxation & Foreign Exchange Laws – Consult a tax expert regarding FEMA (Foreign Exchange Management Act) compliance for receiving international payments. Proper legal agreements and insurance coverage will help safeguard against liabilities arising from patient complications. You can Consult me to draft necessary contracts and compliance frameworks.
