24-Oct-2024 (In Family Law)
I want to ask regarding Inter caste scheme. I am from Rajasthan (OBC)and she is from Maharashtra(SC). As per Rajasthan inter caste scheme the couple gets 10 lakh, but both must be resident of Rj. I got married in April 2024.Can I make a domicile certificate of my wife to avail this benefit? Is it legal? Is there any other central govt or state scheme in which we can get benefit of inter caste ?

To avail the benefits of the Rajasthan inter-caste marriage scheme, both individuals must be residents of Rajasthan, as per the eligibility criteria. While it is possible to apply for a domicile certificate for your wife, domicile is generally based on long-term residence, intent to permanently reside, or significant connections to the state. Obtaining a domicile certificate solely for the purpose of receiving a benefit could raise legal concerns if it doesn’t align with the genuine requirements for domicile status. As an alternative, you can explore central government schemes like the Dr. Ambedkar Scheme for Social Integration through Inter-Caste Marriages, which provides financial incentives for inter-caste couples, regardless of state residency. It is advisable to check with local authorities or legal counsel to ensure compliance with all legalities.
