Registering marriage with a foreigner in Delhi.

18-Oct-2023 (In Family Law)
I am an Indian and my fiance is a foreigner. 1) Can I register my marriage in Delhi even if I am from a different state? I live in Gurgaon and have proof of residence. But all my govt issued IDs are from my state. 2) should upload the documents on Marriage register's website and then visit the office after 2 weeks to get the actual date of marriage. And the actual date of marriage can be 1-3 months from the date of submission of the form? And then the marriage certificate will be issued after 2 more weeks? She comes to India in December. So, should I upload the documents in November before she is here? 3) My fiance's parents are coming with her, and they can act as witnesses. In that case, what would be the proof of residence? Their passport? Or do the witnesses have to be Indian citizens? 4)do I have to show a proof of being single ? 5)she is coming on e-visa. I heard that e-visas can't be converted to X visas after marriage, but it happens in reality. Any insights? Rahul

With a foreigner you should marry under the Special Marriage Act,1954 in the state or district where you are living for at least one month on the date for giving notice for marriage to marriage officer. If you live in Gurgaon you cannot marry in Delhi. You have proof of residence of Gurgaon, use that for moving notice for marriage to marriage officer under the SMA there. Marriage notice has to be given by both parties and unless she's here you alone won't be able to do it.
Now be careful of being made fool by so called marriage touts sitting outside district courts in Delhi and Gurgaon, these can bring more trouble for you rather getting you married in a legal manner.
The proof of age, residence of both parties will be required. Three witnesses with identity proof like Aadhar etc will be required these can be your parents or relatives or friends.
The lady will have to get NOC from her local embassy in India of being unmarried and can marry here in India with you, there is no legal issue for such marriage.
As this for of marriage is civil marriage, no religious ceremonies or process done hence religion of both parties has no relevance, don't think if her conversion to your religion.
The marriage is done only after one month notice period, no discount on that period so the visa of the lady for India should be for more than one month. You don't get misguided by anyone if you're told he can get you married on same day and register the marriage too, such fake marriages can put both of you in big trouble at both ends, for your spouse visa to her country and her spouse visa for India. Lot of youngsters are in deep trouble of such fake marriages and cheats posing as marriage lawyers.

there is no procedure whereby documents of would be marriage can be processed prior to marriage. Once you have the documents pertaining to your IDs from Gurugram then your marriage can only be registered in Gurugram only. if your marriage is being solemnized in Delhi then you can try to contact the registrar of marriage of the area to know the exact procedure. their passport would be enough as their respective ID proofs.
