Query to get bank statement of opposite party

My wife filed petition u/s 24 of HMA though she has sufficient income. Her salary is crediting in bank account. Bank is not providing the Bank statement or bass book. Please suggest me that Can I apply to court to get the order or direction to get the bank statement of my wife. Please clarify. Is RTI act applicable to this matter?

You can file an application in the court stating the woman should file her 3 year bank statement and ITR in court along with her income affidavit. You can give the citation of "Kusum Lata Sharma" judgement passed by the Delhi High Court in support of the same which will make your position stronger for the said request.

You can apply for RTI information under sec. 6 of RT ACT. If they fail to reply, the same can be summoned through court. You have to file an application under order 16 CPC before the family court to summon the records.

Yes. You can pray the court to direct the bank to provide the bank statement of your wife to the court to know your wife's salary details. Similarly, you can also seek information through RTI about your wife's salary details In Kirubananthan K. Vs. PIO, EPFO, Chennai, (Aug. 2, 2017) the Central Information Commission (CIC) has directed the Public Information Officer (PIO) to provide the salary and employment details of the wife under RTI Act. The commission rejected the exemption for disclosure of such information under Section 8(1)(j) of the Act. Hope this helps!
