Procedure to obtain the legal heir certificate to sell the property.

27-Sep-2023 (In Family Law)
My parents have a joint property in their name. I am their only son and my name is there as a nominee. Recently, my mom passed away. Now, my father is unable to sell off the property as there is a legal heirship required from the court. Kindly confirm if this is correct. If so, what are the charges and how to go about it?

The property will be divided equally amongst the legal heirs of the deceased co-owner. After that you can sign a release deed or gift deed in your father’s favour. Thereafter, the property will be solely owned by your father following which your father will become eligible for selling off the said property.
