Poa representing in family court

09-Jan-2023 (In Family Law)
Hi, In the divorce case filed by me respondent wife filed counterclaim application alongwith affidivit of examination for cross and both were signed by her power of attorney. judge rejected the application stating that the party in person has to sign the affidavit. She has gone to high court in appeal of this order. my question is 1. can POA sign on behalf of party on the affidivit ? 2. whether the judge is right in rejecting the application or the same should be allowed or he should tell the respondent to make the necessary changes. 3. An affidivit once submitted can it be withdrawn and refiled ? 4. Can a party submitt her cross examination via video conference or physical presence is required. Tks

Dear queriest, as per your query you have mentioned about the fact that respondent wife has filed appeal in High Court and the same is pending, I would like to state that the Family Court has passed appropriate order even though the respondent Wife has filed appeal it is not gonna work and the same will be rejecred. and it is nothing but dragging of divorce case unnecessarily.
