Parents maintenance under Section 125 IPC Indian Kanoon

I am reaching out to you for urgent assistance. Due to some family dispute, I am leaving separately from my parents for past 3 years. Because of the disputes, My parents have broken all the relations and disowned me in public notice. They are senior citizens and unmeaning fully filed a maintenance case in section 125 crpc. They filed this case in December 2015 and i had to respond back by January 2016, which i did with my lawyer with all the affidavit and i was working that time. In May 2016, my company got shut down and since then am jobless. In last argument call, i showed my relieving letter to the judge and mentioned that am not earning and jobless and yet, he made the decision in their favour for interim maintenance of 20,000 Rupees per month. My father is well earned person but has shown very less income (even lesser than the a daily wages of a labor). I have few questions: 1. Can a parents who are earning well, get a maintenance from jobless son?

As the judge has granted interim maintenance he must have recorded sufficient paramateria in his judgement and reasons to pass interim order but as interim order is not a final order you can file an application with sufficient annexures for modification of that order and if it's doesnot comes in your favour you can challenge the same before high court.

Have you approach the high court against the said order? If your father disowned you in all respect then on what ground he can ask maintenance. You have to assail the interim maintenance order otherwise warrant may be issued against you. Think properly. Revert me . All the best.
