Mother assaulted by stepdaughter and I want to take this to court.

28-May-2025 (In Family Law)
Hi, everybody! My mother 53 y/0 was visiting her husband and 2 stepdaughters (22&28) in their house. We live separately because my mother works in a different city and stepfather another. Their mother had passed away by suicide and her jewellery was handed over to my mother by my stepfather. This time after some disagreement, both stepdaughters assaulted my mother by pushing her around and snatching the bangles she wore while my stepfather sat and watched it all unfold. What to do?

Based on the facts you have shared, your mother has been subjected to physical assault and criminal intimidation by her stepdaughters, and her bangles were forcefully snatched — amounting to robbery and assault under the Bharatiya Nyaya Sanhita, 2023. Here is the course of legal action she can take: 1. File a Police Complaint (FIR): Your mother should immediately lodge a First Information Report (FIR) at the nearest police station alleging the allegations like Voluntarily causing hurt, Assault or criminal force to woman with intent to outrage her modesty, Theft ,Robbery , Criminal intimidation, Common intention. 2. Medical Examination: If your mother sustained injuries, she should get a medical examination done at the nearest government hospital. This will serve as medical evidence during the investigation. 3. Approach Women’s Cell or Protection Officer: Your mother can also file a complaint under the Protection of Women from Domestic Violence Act, 2005 with the local Protection Officer or Women’s Commission. She may be entitled to: Protection Order Monetary Compensation Residence Orders Return of Property (jewellery, etc.) 4. Seek Legal Assistance: Engage an advocate to assist with filing the FIR, legal paperwork, and if necessary, applying for interim relief or protection under relevant laws.
