Land ownership transfer from my father
18-Mar-2025 (In Family Law)
My grandfather's owned land after his death been transferred to my my father with mutual agreement with his sister. Now my father is planning to do gift deed the land to me. Can he do it without my sisters signature as they are are out of states?
since the property is derived ancestrally, your father cannot be alienated the same in your name. he has no absolute rights to alienation. if your father is willing to transfer the said property in your name,
1) let's execute a registered Kharar naama (family agreement) among you all ( father, sisters and yourself) and should mention the property was given to you.
(or)
2) a deed of relinquishment should be executed by your sisters and father in your favour.
