Is HIV positive is a ground of divorce.i m hiv positive ...if my husband files divorce on the basis as I have HIV positive..is court allow the divorce to him ??
As per section 13 clause IV of Hindu Marriage Act, any person can file a petition for dissolution of marriage against his/her spouse on the ground that the spouse is suffering from a communicable disease in a venereal form.
In your case as you are HIV positive hence you have a communicable disease in a venereal form and your husband can seek divorce on this ground.
