I want Resident in Matrimonial house but peacefully

My DV case which i filed feb 2021 is exparte, got resident order in matrimonial house or pay 5k per month from husband. But husband not paying maintenance and is in jail for 1 month. How can i reside in matrimonial house if they still not let me reside in matrimonial home.

If there's no scope of living together then rather stretching the relationship you should go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

Since you have an ex-parte order from the court granting you the right to reside in your matrimonial home or receive Rs. 5,000 per month, your husband is legally bound to comply. However, as he is currently in jail and not paying maintenance, you can take the following steps: 1. Enforce the Order: Approach the court that passed the order and file an execution petition for enforcing your right to reside in the matrimonial home. The court can issue directions to ensure your residence in the house or enforce payment of maintenance. 2. Police Assistance: Since you have a residence order, you can also seek help from the local police to enforce your right to reside in the matrimonial home. Carry a copy of the court order with you for reference. 3. Contempt of Court: If the family of your husband is preventing you from entering the matrimonial home despite the court's order, you may file a contempt petition against them for disobeying the court's direction.

file for the execution of court order before the court which passed the decree in your favour if you have already done so and inspite of the that you are getting the things done then bring it to the notice of court concern and press hard for the same, you also have contempt remedy available
